FTC Approves Final Order in Vipvape APEC Cross Border Privacy Rule Case

After a public comment period, the Federal Trade Commission has approved a final order resolving the Commission’s complaint against Very Incognito Technologies, Inc., doing business as Vipvape, alleging that it deceived consumers about its participation in the Asia-Pacific Economic Cooperation (APEC) Cross-Border Privacy Rules (CBPR) system.

The settlement was first announced in May 2016. In its complaint, the FTC alleged that the company represented on its website that it was a participant in the APEC CBPR system when it was not actually certified to participate.

Under the terms of its settlement with the FTC, Vipvape is prohibited from misrepresenting its participation, membership or certification in any privacy or security program sponsored by a government, self-regulatory or standard-setting organization.

The Commission vote to approve the final order was 3-0.
