Litigation Release No. 24415 / March 4, 2019

Securities and Exchange Commission v. MinTrade Technologies, LLC, No. 1:19-mc-20496-KMW (S.D. Fla., filed February 6, 2019)

Securities and Exchange Commission v. Carla Marin, No. 1:19-mc-20493-UU (S.D. Fla., filed February 6, 2019)

On February 6, 2019, the Securities and Exchange Commission filed subpoena enforcement actions in Florida federal court, seeking orders compelling Mintrade Technologies, LLC (“MinTrade”), a Florida-based entity, and Carla Marin, a resident of Carmel, New York, to comply with subpoenas issued by the SEC.

The SEC subpoenas seek documents from MinTrade, and documents and testimony from Marin, related to activities conducted by a foreign-based broker-dealer and its principal concerning potential violations of the federal securities laws involving solicitation of U.S.-based customers and the movement of customer funds. As stated in the SEC’s applications, a subpoena enforcement action is appropriate where the information sought from the witness is relevant to the investigation. The application does not reflect a determination by the SEC or its staff that MinTrade or Marin have violated provisions of the federal securities laws at issue in the investigation.
